GENERAL SALES TERMS AND CONDITIONS

  1. CUSTOMER REQUIREMENTS

To place orders on the website www.eredichiarini.it (the website) customers must:

– Accept the user’s terms and conditions of this website, Privacy Policy and these general sales terms and conditions.

– Be at least 18;

– Posses the requirements needed to draw up legally-binding agreements.

– Posses a valid e-mail address.

– Posses a credit card valid for payments.

In light of the above, EREDI CHIARINI reserves the right to deny orders placed by customers who fail to meet said requirements. Orders placed from unqualified countries shall not be handled.

In compliance with article 12 of the Legislative Decree No. 70/2003 and article 50 of the Legislative Decree No. 206/2005 as amended by the Legislative Decree No. 21/2014, these terms and conditions may be printed or saved.

2. INFORMATION ON ITEMS ON SALE AND IMAGES

Images, descriptions listing the main features, sizes and prices (VAT included) are available for each Item on sale.

Descriptions and information relevant to the Items found on our website are meant to be of service to our customers. They are merely informative and may not be perfectly and exactly representative of the features of the items they describe.

EREDI CHIARINI declines any accountability on the possible difference between the colors of the items purchased and those seen on the customer’s screen when such difference is due to special settings and/or malfunctioning of the customer’s device.

EREDI CHIARINI declines any accountability for possible inaccuracies that will be promptly corrected when reported.

The sizes of each item are the ones supplied by each Manufacturer.

Our customers confirm they are aware that the same size may have different wearability in each item.

Our customers are aware that during the manufacturing, our suppliers may decide to make adjustments to the items, therefore some differences between the item in the image on our website and the actual item may arise. Should these differences prove substantial, EREDI CHIARINI shall contact you before accepting the order.

3. PRICES and PAYMENT MODALITIES

The prices listed on our website, payments, receipts and invoices of the orders shall be exclusively in Euro.

Prices are inclusive of VAT.

Potential shipping or payment costs are notified to customers through our website.

Eredi Chiarini reserves the right to change the prices of the items at any time, without notice.

Customers are required to check the final sale price before they submit their order.

Each order shall break down the costs of the single items purchased and their total price.

Items for sale shall be listed in the potential invoice exclusively with the final price already discounted.

EREDI CHIARINI accepts only payments coming through:

  • Visa, Mastercard and American Express credit cards.

Transactions are processed through a safe server, guaranteeing our customers’ maximum data protection.

EREDI CHIARINI shall not add fees to use the above-mentioned payment means, or, in some instances, tariffs exceeding those paid by the company.

In the event of purchases made through credit card, the financial data shall be forwarded to the bank offering the remote electronic payment service through scrambled file. EREDI CHAIRINI shall use such data solely to proceed with the purchase or potential reimbursement in the event of item return upon right of withdrawal, or to report possible frauds to the competent authority. Eredi Chiarini shall not retain such data and shall not be held liable for potential deceitful and illicit use of credit cards by third parties at the moment of the payment.

Please be aware that neither the operators at the EREDI CHIARINI Customer Service nor its Personal Shopper are authorized to ask for and/or accept credit cards details and/or expiry details.

To guarantee further safety in e-commerce purchases, EREDI CHIARINI advises its customers to subscribe to the Verified by Visa or Mastercard Securecode services, or to contact their bank to obtain information on the subject.

4. PURCHASING PROCEDURES AND ORDER HANDLING

To place an order, please follow the procedure on our website providing all the data required.

Before and during the purchasing procedure, customers may ask for the issuing of an invoice providing all the required tax details; invoices may not be requested or issued later.

Submitting a purchase offer to the seller is binding for customers.

Customers may check the progress of their order in the dedicated page on our website www.eredichiarini.it.

EREDI CHIARINI will email customers to confirm receipt of the purchase offer, and to send a simple summary of the items listed in the purchase offer to be checked by the customer. Such email shall not be considered as an approval of the purchase order.

Should EREDI CHIARINI detect an error in the price of the item or in the sum required as payment, the purchase order shall be denied and customers shall be contacted via email to let them submit a correct purchase order of the item(s) at the correct price.

Eredi Chiarini shall send another email to the customers, this time to be considered effective as –partial or full- approval of the order only once the correctness of the data submitted by the customer and the availability of the items has been verified.

The purchase agreement shall be considered settled for the items listed only once the customer receives this second email.

EREDI CHIARINI reserves the right to deny purchase orders when:

– the data provided are incomplete or wrong,

– Customers are not providing enough solvency guarantees

– payments are not successful or our bank is not able to obtain validation from the client’s bank.

If the capital present in the payment method of your choice is sufficient, and all the details, inclusive the bank details, are correct, EREDICHIARINI.IT shall accept the order once the transaction is confirmed by our bank.

Should the client select a wire transfer as means of payment, the confirmation order shall be sent only once the transfer clears on our bank account.

Once the order has been accepted, Customers will not be able to amend and/or cancel custom-made and/or personalized items.

At their discretion, EREDI CHIARINI may process separately orders listing more items.

The availability of the items sold on our website is updated in real time.

Technical problems, malfunction of suppliers or order placed by different customers at the same time may cause delays in the stock. Therefore, EREDI CHIARINI reserves the right to reconfirm the availability of the items listed in the order.

Should the items requested be no longer available or for any reason the order not be handled, EREDI CHIARINI shall notify the client via email.

Should the 30-day maximum delivery terms fail to be respected, Customers will accept a delayed delivery date suitable to the circumstances writing to customerservice@eredichiarini.it . Should the additional time granted expire and the items fail to be delivered, Customers shall have the right to terminate the contract.

As an alternative to the shipping, Customers may decide to collect the items purchased at the store in Florence. An email will notify the Customers when the items are available for collection. Customers have 15 days as of the reception of said email to collect their items, after which they will be shipped to the client with shipping costs charged on the addressee.

Shipping shall be made through a courier service selected by EREDI CHIARINI.

Shipping is free of charge for Customers in Italy.

For shipping outside Italy, shipping costs shall be charged on the Customers and will be specified before the conclusion of the order request.

Items will be delivered to the address listed in the field “shipping address” in the purchase order.

Non custom-made and/or personalized items available in stock are usually shipped within three working days of the order confirmation. Shipping may take longer during sale or promotion periods.

Shipping is handled Monday through Friday from 10am to 4pm.

Order requests placed at the weekend and on holidays (January 1st, January 6th, Easter and Easter Monday, April 15th, May 1st, June 2nd, August 15th, November 1st, December 8, 25 and 26) shall be handled the following Monday.

In any case, EREDI CHIARINI reserves the right to delay the shipment in the event or force majeure.

EREDI CHIARINI is not liable for possible delays due to courier, custom operations and controls, force majeure or events not ascribable to EREDI CHIARINI.

Once the order has been shipped, EREDI CHIARINI will email the client the tracking number and a link to track the shipping.

Please carefully check the package with the courier before you sign the receipt.

The parcels coming from EREDI CHIARINI are packaged and sealed with tape bearing the writing “EREDICHIARINI”.

If you detect the parcel to haven been tampered with or if the tape is not intact, please sign “subject to confirmation”, reporting the courier immediately and emailing EREDI CHIARINI at customerservice@eredichiarini.it

Customers placing an order request undertake to accept the delivery of their package.

Should the package fail to be delivered for reasons depending on the client (wrong address, repeatedly absent addressee, wrong phone number, rejection, etc.) shipping and reshipping costs and potential custom fees shall be charged to the client.

5. RETURNS

Should for any reason Customers be unsatisfied of their purchase, they may exercise their right of withdrawal within 14 working days of the reception of the items.

The right of withdrawal is not exercisable for custom-made and/or personalized items.

Within 14 working days after the exercise of the right to withdrawal, Customers shall return to EREDI CHIARINI the items subject-matter of the right to withdrawal.

The right to withdrawal and the subsequent return of the items are subject to the following conditions:

  • All the items shall be integral, also of possible accessories and original labels still attached to the items, with original packaging and boxes, unaltered and not used as single top package.
  • Items cannot have been worn, used, washed, or altered, and cannot bear any sign of use and/or damage.
  • Shoes will show intact soles, with no sign of having been used.
  • Returns without previous notification of the Customers shall not be accepted.
  • Returns shipped with couriers other that the one decided by EREDI CHIARINI shall not be accepted.
  • Should the items fail to meet the conditions above, returns shall not be accepted and reimbursements shall not be granted. In these cases, the items shall be shipped again to Customers who will be in charge of shipping costs.
  • Returns shall not be accepted for personalized items (for instance, embroidered initials, adjustments, custom-made items). Likewise, sealed items that were opened after the delivery and that cannot be returned for hygienic or health reasons.

6. INSTRUCTIONS FOR RETURNS

  1. To apply for a return of your items, please fill in the form and email it to: customerservice@eredichiarini.it
  2. Please list the code(s) of the item(s) you wish to return.
  3. Once EREDI CHIARINI receives your return request, you will receive a written confirmation with the number of return authorization (R.A.N.).
  4. The items to be returned must be couriered to Italy at the address indicated in the confirmation email.
  5. Returns must be sent using the courier company specified in the email you received from EREDI CHIARINI. Please write the Return Authorization Number (RAN) on the consignment note that must be filled in as per the instructions in the authorization email sent by EREDI CHIARINI.
  6. Return costs are upon EREDI CHIARINI.
  7. If the right to withdrawal is implemented following the modalities and terms of which above, once EREDI CHIARINI receives the items listed in the return request, and once the contents and condition of the items have been checked, you will receive an email with the confirmation of the returned items.
  8. The reimbursement shall follow transferring the relevant sum to the credit card you used to pay for the order.

On the basis of the withdrawal, all the payments shall be reimbursed to you except for delivery costs, if any. For orders paid through credit card, the reimbursement, without interests, shall be available in about 15 days and in any case shall clear on your credit card statement the following day. Timings may change slightly depending on the bank circuit of the credit card used.

Should you receive flawed items or should EREDI CHIARINI make a mistake in the shipping, please follow the same instructions above. EREDI CHIARINI reserves the right to ask for photographic proof before authorizing returns for flawed items and bearing the shipping costs to return the items.

EREDI CHIARINI reserves the right to refuse unauthorized returns or returns send with a different courier than the one specified in the return instructions.

Customers shall be responsible for possible decrease in the value of the item(s) caused by handling in a way that was unnecessary to assess the characteristics and functioning of the items sent.

Customer Service shall contact the Customers should their return prove non-compliant with the conditions listed above. In this case, Customers may opt for a reduction in the reimbursement, equal to the decrease in the value of the items returned; otherwise, Customers may decide to reacquire the item(s) at their own expense. Should Customers refuse to receive the return of the item(s), EREDI CHIARINI shall keep the item(s) and the sum established as decrease in the value of the returned item(s).

6. AUTHENTICITY AND LEGAL GUARANTEE OF CONFORMITY

As authorized retailer of all the brands listed on its website, EREDI CHIARINI guarantees the authenticity of each item sold. All the items on this website are covered by 24-month legal guarantee in compliance with Title III of the Legislative Decree No. 206/2005.

Should you detect a flaw in the conformity of the items purchased from this website in the period of effectiveness of the legal guarantee, please notify customercare@eredichiarini.it within two months of the discovery, listing your personal data (full name and address for the collection) and order number.

The company shall organize the collection of the item(s) at its expense, as well as the new shipping.

In the event of non-conformity, Customers have the right to claim – free of charge – the fixing or replacement of the item.

Should such fixing be impossible or exceedingly expensive, Customers shall be entitled to a decrease in the price paid or to the termination of the sale agreement, under article 130 of the Consumer Code.

Once the item under guarantee has been received and checked, EREDI CHIARINI shall have it fixed or replaced as soon as possible, unless for what is provided for in article 130 of the Consumer Code in the event of impossibility or excessive cost.

Any possible legal action for lack of conformity must be taken within 26 (twenty-six) months of the date of reception of the relevant item(s).
The guarantee on flaws in conformity applies exclusively to items used correctly and in compliance with their function and washed according to the instructions listed in the label sown inside the item or supplied with it.

To use the guarantee, Customers shall prove the date of the purchase keeping their payment receipt.

The legal guarantee does not apply to possible flaws, imperfections, damage and/or malfunctioning due to accident or responsibility of the Customers, or to non-compliant use.

AMENDMENTS TO THE GENERAL SALES CONDITIONS

EREDI CHIARINI reserves the right to amend and/or supplement at any time these General Sales Conditions. Any amendment and/or supplement shall be effective as of the date of their publication on this website.
